ChainCatcher news, according to CoinDesk, Coinbase Global Inc. (COIN) will file a final lawsuit regarding its unregistered securities dispute this Tuesday. A knowledgeable source stated that Coinbase will continue to assert its argument that the SEC has not proven that these transactions are investment contracts (i.e., securities), as it has not demonstrated the existence of any actual contracts, and the SEC is violating the "major questions doctrine," which holds that federal agencies lack the authority to regulate new areas awaiting congressional action.
After the Tuesday deadline for Coinbase's application, Judge Katherine Polk Failla of the U.S. District Court for the Southern District of New York will hear full arguments from both sides.
The judge has previously expressed skepticism about the SEC's arguments, and if she is persuaded by Coinbase's legal reasoning, she could dismiss the case; however, at this stage, it is generally unlikely to dismiss government enforcement actions.
