The Department of Justice has always believed that Zhao Changpeng should be restricted to residing in the continental United States and prohibited from traveling to the UAE; the defense argues that there is no legal basis for Zhao Changpeng facing a short-term sentence, and the upper limit of the guideline could be as high as 18 months, while the U.S. can freely assert any maximum statutory sentence of up to 10 years.
Additionally, the court documents suggest that the court should also consider how long the defendant has lived in the United States; whether they work in the U.S., own property, or have family; and whether they have relatives who are U.S. citizens. These factors are all unfavorable to allowing Zhao Changpeng to return to the UAE. U.S. authorities believe that Zhao Changpeng poses a flight risk, which can be managed by requiring him to stay in the U.S. and releasing him before he is sentenced.
