The judge ruled: Gemini and CFTC lacked sufficient grounds, the application to withdraw the $5 million settlement agreement was denied
Federal District Judge Alvin Hellerstein in New York dismissed the joint application of Gemini and the Commodity Futures Trading Commission (CFTC) to revoke the $5 million settlement agreement. Gemini and the CFTC had stated in May that the settlement agreement reached in January 2025 violated the fundamental principles of fair enforcement.
The judge ruled that the aforementioned reasons were insufficient to support the revocation of the settlement and noted that Gemini voluntarily signed the agreement three weeks before the trial.
